TDIU Application Walkthrough: How to Complete VA Form 21-8940
Filing for Total Disability Individual Unemployability requires VA Form 21-8940. Here is how to complete each section and what evidence to submit with it.
Total Disability Individual Unemployability allows veterans with combined ratings below 100 percent to receive compensation at the 100 percent rate if their service-connected disabilities prevent substantially gainful employment. The primary application document is VA Form 21-8940.
Who should file
To qualify for schedular TDIU under 38 CFR 4.16(a), you need either a single service-connected disability rated at 60 percent or more, or a combined rating of 70 percent or more with at least one disability rated at 40 percent or more. For extraschedular TDIU under 38 CFR 4.16(b), the rating thresholds do not apply if your disabilities prevent gainful employment regardless of the percentages.
Substantially gainful employment means employment that pays above the poverty threshold. Marginal employment, including sheltered work or work with a family business at reduced productivity, does not disqualify you.
Section by section guide
Section I asks for your personal information. Use your legal name exactly as it appears on your VA records. Include your VA file number from your rating decision letters.
Section II asks about your disabilities. List every service-connected disability, not just the ones you believe prevent employment. All of your service-connected conditions are considered together.
Section III asks about employment. List every employer in the past five years. Include the employer's name and address, your job title, the dates of employment, why you left, and your earnings. If you were self-employed, describe the work. If you have not worked in the past five years, explain why.
Section IV asks about your education and training. List your highest level of education, any vocational training, and any specialized skills from military service that would be relevant to civilian employment.
Supporting evidence to attach
A statement from your treating physician explaining specifically how your service-connected disabilities prevent you from maintaining substantially gainful employment. The letter should address physical limitations, cognitive impacts, attendance and reliability issues, and any other relevant functional deficits.
If you were terminated from employment or left positions because of your disabilities, documentation of those circumstances strengthens the application. Employer letters, termination notices, or your own personal statement describing what happened.
Buddy statements from former supervisors, coworkers, or family members who have observed how your disabilities affect your ability to work.
After you file
The VA may schedule an additional C&P examination specifically for TDIU. Prepare for this examination the same way as for any C&P exam: describe your worst days, focus on functional limitations, and bring documentation.
Processing time for TDIU claims varies. You can check status at VA.gov or through your VSO.
