WHAT THE PACT ACT MEANS FOR YOU

The PACT Act is a 2022 law that made it significantly easier for veterans to get VA disability benefits for conditions related to burn pits, Agent Orange, and other toxic exposures. For qualifying conditions, VA now automatically assumes your service caused the condition -- you no longer have to prove it.

YOUR SERVICE ASSESSMENT

Based on your service in Iraq from 2003 to 2005, you qualify for the burn pit and toxic exposure presumptive category. Iraq is a qualifying location for veterans who served on or after August 2, 1990.

1. Schedule a free toxic exposure screening at any VA facility by calling 1-877-222-8387.

2. File a disability claim at va.gov/disability/file-disability-claim. Select burn pit or toxic exposure as your exposure type.

3. You do not need a nexus letter. Your DD-214 showing Iraq service plus your asthma diagnosis is sufficient.

Questions about this tool

I was denied before 2022. Can I still get benefits under the PACT Act?

Yes. If you were denied for a condition that is now on the PACT Act presumptive list, you can file a Supplemental Claim with new and relevant evidence. The previous denial does not prevent you from refiling. A VSO can help you with this at no cost.

Do I need a doctor's letter connecting my condition to burn pit exposure?

No. For presumptive conditions, VA automatically assumes the connection. You need your service records showing you served in a qualifying location and medical records showing your current diagnosis. A nexus letter is not required for presumptive claims.

Is there a deadline to file a PACT Act claim?

There is no deadline to file. However, veterans who filed by August 14, 2023 were eligible for back pay to August 10, 2022 when the law was signed. Veterans filing after that date will receive benefits going forward from their filing date.
